I am so pleased to have been invited to deliver a paper at this year’s API NSW Public Sector Property Conference to discuss implications of the decision of the Court of Appeal in Roads And Maritime Services v Desane Properties.

The conference session will discuss the comments of the Court on compulsory acquisitions of part sites leaving residual land adversely affected in value by the public purpose served by the primary acquisition.

There are intriguing practical and legal issues raised by these comments, particularly for valuation issues under section 55 (f) Land Acquisition (Just Terms Compensation) Act.
